1. Using EverPaw Garden

EverPaw Garden is a memorial service for pets and the people who love them. By using the service, you agree to use it lawfully, respectfully, and in accordance with these Terms.

2. Accounts and Access

• You must provide accurate information when creating or accessing an account.
• You are responsible for activity that takes place through your account or login method.
• We may limit, suspend, or refuse access where reasonably necessary to protect the service, enforce these Terms, or comply with legal obligations.

3. Your Content

You retain ownership of the content you submit, but you grant us the rights needed to operate the service.

• You grant us a non-exclusive, worldwide, revocable license to host, store, reproduce, adapt, and display your content solely for the purpose of operating, improving, and securing EverPaw Garden.
• You confirm that you have the right to upload the names, photos, writings, and other materials you submit.
• You must not submit content that infringes another person's privacy, publicity rights, copyright, trademark, or other legal rights.

4. Acceptable Use

You may not use EverPaw Garden in a way that is unlawful, abusive, fraudulent, or harmful.

• No hate, threats, harassment, impersonation, malware, scraping abuse, spam, or fraudulent conduct.
• No content that is sexually explicit, defamatory, violent, or otherwise unlawful.
• No attempts to interfere with the normal operation, security, or integrity of the service.

5. Support Payments

Support payments help keep the service online and cover operating costs.

• Support payments are voluntary unless a clearly described paid product or feature is presented at checkout.
• Except where required by law, or in the event of duplicate or unauthorized charges, voluntary support payments are generally non-refundable.
• Payment processing is handled by PayPal and is subject to PayPal's own terms, policies, and dispute procedures.

6. Availability and Changes

• We may change, suspend, or discontinue any part of the service at any time.
• We may remove content, suspend accounts, or refuse access where we reasonably believe there is abuse, legal risk, or a violation of these Terms.
• We do not guarantee uninterrupted availability, error-free operation, or permanent access to any feature.

7. Disclaimers and Liability

To the fullest extent permitted by law, EverPaw Garden is provided on an "as is" and "as available" basis.

• We disclaim implied warranties except where such disclaimers are not permitted by law.
• To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or exemplary damages arising from your use of the service.
• Nothing in these Terms limits liability that cannot lawfully be limited.

8. Intellectual Property & DMCA Policy

EverPaw Garden respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to notices of alleged infringement. If you believe that material on the service infringes a copyright you own or control, please send a formal notice to our designated agent at hello@everpawgarden.com.

• To be effective, your notice should include a physical or electronic signature of the copyright owner or an authorized agent.
• Identify the copyrighted work claimed to have been infringed with enough detail for us to review the claim.
• Identify the material claimed to be infringing and where it appears on the service, including the relevant URL or memorial page location.
